This Terms and Conditions document (together with the Delivery Options, 30 Day Return Policy, Acceptable Use Policy and Your Privacy & Security Online pages on this site) governs the use of EziBuy's Online Service (the Service) including shopping and participation in promotions run by EziBuy. By using the Service, you agree to be bound by this document (and those pages). You can access this document at any time from the bottom of any page of the site.

Purchasing from EziBuy.com

EziBuy shopping gives customers convenient, quick, easy and secure shopping.

Products displayed on the site shopping areas can be purchased using a secure online Mastercard, Visa, Diners Club and American Express transaction facility. Customers can be confident that all of their credit card details are protected by the latest security mechanisms and are used only for purposes of the transaction fulfilment or as otherwise authorised by you or permitted by law.

You will be asked to register as a member of EziBuy.com Apart from the many member benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you checkout.

The contract relates to those products whose dispatch has been confirmed by the supplier. The supplier will not be obliged to supply any other product which may have been part of your order until the dispatch of those products has been confirmed. Your credit card payment will be processed by the supplier at the time your products are dispatched. If required, a $1 authorisation fee may be temporarily applied to verify the validity of your credit card at the time the order is processed.

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when the supplier receives full payment of all sums due in respect of the products, including delivery charges. It is your responsibility to ensure the correct delivery address details have been entered at the time of ordering. EziBuy is not liable for any costs associated with resending an order due to delivery address details being incorrect. Shipping may take additional time during sale periods, holidays and extreme weather events.

Pricing

All prices and delivery charges on our site are in Australian dollars (AU$) and include GST (if any). We reserve the right to alter prices and delivery charges for any reason at any time. If this should happen after you have placed an order, we will contact you prior to processing it.

As importer of the products, you will be required, where their Customs value exceeds $1,000, to make an import declaration to the Australian Customs and Border Protection Service and to pay the calculated duty, GST and other taxes and charges. You authorise the supplier to arrange for a third party to complete the Customs and Border Protection requirements.

The supplier will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under its contract with you that is caused by an event outside its reasonable control.

Contracts for the purchase of products using the Service, and any dispute or claim arising out of or in connection with them or their subject matter or formulation, will be governed by Australia law. Any such dispute or claim shall be subject to the non-exclusive jurisdiction of the Australia courts.

Security

We use the secure Hosted Payment page solution from Windcave to process online orders. Customers can see their cards being authorised in real time, all in an SSL secure environment. The Hosted Payment page enables us to offer customers a safe and speedy online shopping experience.

Windcave is committed to protecting the security of your data. We use a variety of security technologies and procedures to help protect your personal information from unauthorised access, use or disclosure. For example, we store the personal information you provide in computer servers with limited access that are located in controlled facilities secured by the latest in surveillance and security technology. When we transmit sensitive information (such as a credit card numbers) over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Credit card details stored on site are encrypted using 168bit 3DES encryption. Windcave is also certified AIS compliant.

MarketPlace Products: THIRD PARTY SELLERS

Marketplace Products are sold and supplied to customers directly by a third-party seller, not by EziBuy, and shipped directly from the third party seller’s warehouse.

The third-party seller is responsible for listing, selling and delivering the product, and all product information.

EziBuy has not verified, and does not make or adopt, any representations regarding the product.

Marketplace Products are subject to Australian Customs and Duties charges upon delivery.

Marketplace Products are excluded from all general site-wide promotional activity, including Reward Vouchers and do not contribute to your Membership seasonal rebate spend, unless and only if there is a specific promotional offer on the Marketplace Product.

Use of the Service by You

Your right to use the Service is personal to you. You may not authorise others to use the Service, and you are responsible for all of your own use of the Service.

You may not download, modify, transmit, or otherwise use any material from the Service for public or commercial purposes.

The Service's content, information and advice is free of charge (unless otherwise stipulated). However you are responsible for your own network and connection charges.

Other than connecting to EziBuy's servers by HTTP requests using a web browser, you may not attempt to gain access to EziBuy's servers by any means - including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service or otherwise.

You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way and you agree not to impede or interfere with others' use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, EziBuy and/or the Service.

You also accept, and agree to abide by, our Acceptable Use Policy, which applies to all users of the Service and our website.

EziBuy will over time provide content and information which children may find interesting and may wish to access. However, no one under the age of 13 years is allowed to provide any personal information.
